Preamble

We, the people of the State of San Andreas, in order to establish justice, ensure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the State of San Andreas.

This Constitution, and the Laws of the State of San Andreas in the republic of Concrete which shall be made in Pursuance thereof; under the Authority of the Federal Government, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any state to the Contrary notwithstanding.

All citizens employed by public funds shall be bound by Oath or Affirmation, to support this Constitution.

Section 1: Fundamental Rights

1. Equality: All individuals are equal before the law and have the right to the equal protection benefit of the law without discrimination.

2. Freedom of Speech and Expression: Every person has the right to freedom of thought, belief, opinion, and expression, including freedom of the press and other media.

3. Right to Privacy: Every person has the right to privacy and to be free from unreasonable searches and seizures.

4. Freedom of Assembly: The right to peaceful assembly is guaranteed.

5. Right to Petition: The people have the right to petition the government for the redress of grievances.

6. Freedom of Religion: Every person has the right to freedom of conscience and religion.

Section 2: Civil Liberties

1. Right to Life, Liberty, and Security: Every person has the right to life, liberty, and security of the person.

2. Protection from Discrimination: No person shall be discriminated against based on race, color, sex, language, religion, political or other options, national or social origin, property, birth disability, or other status.

Section 3: Legal Rights

1. Right to Due Process: No person shall be deprived of life, liberty, or property without due process of law.

2. Right to a Fair Trial: Every person is entitled to a fair and public hearing by an independent and impartial tribunal.

3. Protection from Self-Incrimination: No person shall be compelled to testify against themselves in a criminal case.

4. Protection from Double Jeopardy: No person shall be tried twice for the same offense.

The San Andreas Department of Justice, under the Chief Justice, shall have authority over all legal and judicial matters within San Andreas, with power vested by the Federal Government. It shall ensure the enforcement of laws, uphold justice, and protect the rights of citizens through the precedent set within the judiciary. Precedents set by this judiciary will act as Common Law and shall act as the supreme law of the land as amendments to the San Andreas Constitution. The DOJ shall be responsible for overseeing other law enforcement offices in preserving the integrity and safety of the State, the Constitution, citizens' rights, and the laws of the State.

The judicial power of the State of San Andreas is vested in the Supreme Court, lower courts as established by law, and other courts as deemed necessary. Judges shall be independent and free from external influences, ensuring fair and impartial justice.

The State of San Andreas shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

No soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by the law.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or thing to be seized.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

In all criminal prosecution, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the State of San Andreas, or any place subject to their jurisdiction.

The right of citizens of the State of San Andreas to vote shall not be denied or abridged by the State of San Andreas on account of race, color, or previous condition of servitude.

The executive branch of government shall have the power to lay and collect taxes on incomes, from whatever source derived, and without regard to any census or enumeration.

The right of citizens of the State of San Andreas to vote shall not be denied or abridged by the State of San Andreas on account of sex.
